I acknowledge that my participation in Fluid Calm’s treatments is subject to this Health Waiver (“Waiver”), in conjunction with Fluid Calm’s Terms and Conditions, Cancellation and refunds policy and Privacy Policy.
Capacity to Contract
I warrant and agree that I have the capacity to agree to the terms of this Waiver and be legally bound by them.
I acknowledge that I have read and understood the terms of this Waiver prior to signing the Agreement, and have sought professional and/or legal advice should I require clarification on any aspect of the Waiver. I acknowledge that Fluid Calm will rely upon any information I provide as being accurate to the extent of my knowledge.
Disclosure of Medical and Health Information
I will disclose any existing medical conditions or injuries, both before and after agreeing to this Waiver, to Fluid Calm. I understand and acknowledge that Fluid Calm may refuse my participation in the treatments based on this information.
This is particularly important when making future bookings, as it is possible that you may become contraindicated and cannot have colon hydrotherapy at this time.
Assumption of Inherent Risks
I understand that Fluid Calm is not responsible for any inherent risks that may arise out of using any Equipment, including (but not limited to) injuries that occur as a direct or indirect result of negligence, misuse, setup, or Equipment failure.
These inherent risks may include, but are not limited to: Equipment Failure: While Fluidcalm endeavours to provide safe and properly functioning equipment, I understand that equipment failure can occur due to various factors, including manufacturing defects, normal wear and tear, or improper use. I acknowledge that Fluid Calm is not the manufacturer of the Equipment, and any equipment failure resulting from manufacturing defects is subject to the terms of the manufacturer’s warranty. I acknowledge that while colonic hydrotherapy is generally considered safe, all procedures carry some level of risk.
Colonic hydrotherapy can spread viral, bacterial or fungal infections from one client to another through contaminated equipment and surfaces. The procedure can cause some other injuries to clients if it is not performed correctly if an underlying condition is present or that they are inherent in the undertaking of any therapy. These can include trauma to the colon, such as ulceration or perforation or worsen chronic bowel disease such as diverticulitis, Crohn’s disease or haemorrhoids. The procedure may cause thermal shock or scolding and there are additional risks with dehydration, over hydration and disruption of intestinal flora and electrolyte balances. To minimise any such risk, it is recommended that clients undertake prior consultation with their healthcare provider to ensure the procedure will not have any unintended consequences or effects.
Indemnification and Release
I acknowledge that I voluntarily participate in the treatments and use any associated equipment at my own risk, and indemnify and release Fluid Calm and its owners, shareholders, officers, employees, contractors, agents, successors and assigns from any and all liabilities, claims, demands, expenses and losses that may arise as a result of or in connection with my participation in the treatment or use of the Equipment, including (but not limited to) damage to property, personal injury (whether minor or serious), health complications or the aggravation of an existing condition.
I understand that Fluidcalm strives to maintain a safe environment and provide qualified practitioners. However, I acknowledge that Fluidcalm cannot guarantee my safety or eliminate all risks associated with the treatment.
These terms and conditions are governed by and construed in accordance with the laws of NSW.
